TERMS OF SERVICE

1. INTRODUCTION
Welcome to Omja Living (Omja Living Private Limited) ("Omja Living", "Company", "we", "us", or "our").

Omja Living offers furniture, lighting, rugs, home décor, textiles, accessories, and related products to customers located in India and selected international markets including, but not limited to, the United Arab Emirates, Kuwait, Qatar, Singapore, Hong Kong SAR, Thailand, and Indonesia.

5. PRICING AND PAYMENT
All prices displayed are subject to change without notice.
Prices may be displayed in various currencies for customer convenience. Final billing may occur in the currency selected during checkout or as determined by the payment processor.
Unless otherwise stated:
  • Prices do not include applicable taxes, customs duties, import charges, brokerage fees, or local governmental levies;
  • Shipping and delivery charges may be calculated separately during checkout.

6. ORDER ACCEPTANCE
Submission of an order constitutes an offer to purchase products from Omja Living.
Receipt of an order confirmation email does not constitute acceptance of your order.

Customers purchasing products outside India acknowledge and agree that:

  • Such charges are the sole responsibility of the customer unless expressly stated otherwise;
  • Omja Living is not responsible for delays arising from customs clearance or government inspections;
  • Customers are responsible for ensuring that purchased products may legally be imported into their country.
Failure to pay customs charges or accept delivery shall not constitute grounds for cancellation or refund except as required by applicable law.
8. SHIPPING AND DELIVERY
Delivery timelines are estimates only and are not guaranteed.
We are not responsible for delays resulting from:
  • Customs procedures;
  • Transportation disruptions;
  • Weather conditions;
  • Labour disputes;
  • Government restrictions;
  • Force majeure events;
  • Third-party carrier delays.
Risk of loss and ownership of products shall transfer to the customer upon delivery to the shipping carrier or upon delivery to the customer, as applicable under local law.
Customers are responsible for providing accurate shipping information.
9. INTELLECTUAL PROPERTY
All content available through the Services, including but not limited to:
  • Product designs;
  • Product photography;
  • Catalogues;
  • Logos;
  • Trademarks;
  • Graphics;
  • Website design;
  • Text;

10. USER CONTENT AND REVIEWS

By submitting such content, you grant Omja Living a worldwide, perpetual, royalty-free, transferable, and sublicensable license to use, reproduce, publish, modify, display, distribute, and promote such content in any media.
You represent that:

  • The content does not infringe third-party rights;
  • The content does not violate applicable laws.

  • Trade restrictions;
  • Transportation disruptions;
  • Labour disputes;
  • Internet or telecommunications failures;
  • War, terrorism, or civil unrest.
17. TERMINATION
We reserve the right to suspend, restrict, or terminate access to the Services at any time without prior notice where we reasonably believe a violation of these Terms has occurred.
Termination shall not affect any rights or obligations accrued prior to termination.
18. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions shall continue in full force and effect.
19. ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and Omja Living concerning the Services and supersede all prior communications, agreements, or understandings relating thereto.
20. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of the Republic of India.
Any dispute arising out of or relating to these Terms, the Services, or any purchase made through the Services shall be subject to the exclusive jurisdiction of the competent courts located in Gurugram, Haryana, India.
Nothing in these Terms shall limit any mandatory consumer rights available under applicable law.
21. MODIFICATIONS TO THESE TERMS
Omja Living reserves the right to amend, update, or modify these Terms at any time.
Updated versions shall become effective upon publication on the website unless otherwise stated. Continued use of the Services following such changes constitutes acceptance of the revised Terms.
